Forty tenants staying illegally in Fort area – Noticed Issued by Port Trust’s.

Mumbai Port Trust Notice.

Mumbai Port Trust’s board of trustees had filed a petition against the trust’s estate officer because the building owners were living illegally. It is seen that they have acquired this place as a tenant and haven’t renewed the lease agreement past 50 years.

Since 1985, 40 tenants have captured the building and are staying without doing the paperwork.

This Forty tenants of a building in the Fort area in south Mumbai, have been noticed to vacant the premise in two weeks, i.e 14 days.

According to the order by Mumbai Port trust, if they fail to vacant the place, then they will be forcibly evicted.

Let me tell you that this engineer building, is an 85- years old which is been located in Shahid Bhagat Singh Marg, and is having 6 houses and 34 commercial establishments.

The order expresses that the proprietor needs to pay Rs 13.19 crore, with 18% interest per annum, and looks for remuneration.

Mumbai Port Trust order defines “In case of refusal or inability to agree to this order inside a predetermined period, the tenant, Zohrabibi Khan, and every single concerned individual will be subject to be expelled from the said premises and, if the need emerges, to use force as may be necessary.”

The plot was eventually doled out to Jeenabhai Shah, Nishar Mohammed Suleman and Zoharbibi Khan as joint tenants.

Mumbai Port Trust authorities have said there was no reestablishment condition and, with regards to the 1935 understanding, they were to hand over ownership of the premises after the expiry of the rent in 1985.

While two joint occupants passed on in 1981, Zohrabibi Khan is currently the main renter. The Port Trust asserted that it had issued her a notice in 1991 about expiry of rent.

In 2002, it requested that her compensation Rs 21 lakhs as a security deposit, back payments, premium for breach, punishment and lawful expenses. She paid Mumbai Port Trust Rs 4 lakhs in 2005 and mentioned to enable her to pay the parity in portions.
