Dadar Redevelopment Dispute: Tribunal Orders 2% Penalty, Conveyance to Housing Society
Mumbai: The Maharashtra Real Estate Appellate Tribunal (MahaREAT) has directed the promoters of RA Residences in Dadar East to pay a penalty equivalent to 2% of the project cost, in a dispute concerning changes to the project’s development plans. The dispute concerns revisions made to the project after the plan presented to homebuyers in 2017. The commercial component was subsequently expanded, with additional FSI/TDR being utilised.
MahaREAT has directed that proceeds generated from commercial units developed through additional FSI/TDR beyond the original plan be apportioned among eligible allottees. The promoters have also been ordered to complete the conveyance of the residential building within 60 days.
The tribunal further directed the promoters to demarcate and hand over 64 remaining guest-parking spaces to the housing society. It also sought audited accounts covering maintenance, clubhouse and corpus-fund collections, with amounts found payable to the society to be refunded as applicable.
Issues concerning incomplete works, repairs, defects and service deficiencies have been referred back to MahaRERA for fresh consideration.
The order covers several aspects of the long-running redevelopment dispute while leaving certain project-related issues for examination by the real estate regulator.
