Supreme Court Dismisses Plea Against Additional FAR for Ekanam Project in Noida

The Supreme Court on September 22 dismissed a Special Leave Petition (SLP) filed by the Great Value Sharanam Apartment Owners Association challenging the additional Floor Area Ratio (FAR) approved for Great Value Realty’s Ekanam residential project in Sector 107, Noida.

The order leaves in place the Allahabad High Court’s decision, which had upheld the Noida Authority’s approval for an additional 0.60 FAR for the development.

Ekanam is planned on approximately four acres that formed part of a larger 20-acre parcel leased by Great Value Realty from the Noida Authority between 2010 and 2015. The remaining 16 acres were developed as the Sharanam residential project, which was delivered in 2018.

The additional FAR was approved by the Noida Authority in December 2024, while the building plan for Ekanam was sanctioned in June 2025.

The proposed development comprises three 46-storey towers with around 280 three- and four-bedroom residences. Apartment sizes are reported to range from approximately 3,525 sq ft to 5,525 sq ft. The project has an estimated construction potential of around 2 million sq ft and a reported revenue potential of approximately ₹3,000 crore.

The dispute arose over whether the additional development potential could be used for a separate residential project or whether it should instead benefit residents of the existing Sharanam development.

During the proceedings, the Noida Authority conducted a verification of homeowner consents and objections. The authority recorded 978 valid consents and 228 objections. The Allahabad High Court subsequently upheld the approval, noting that the disputed land had been identified for future development and was not part of the existing project’s designated common open spaces or community facilities.

The apartment owners’ association then approached the Supreme Court. After considering the matter, the apex court declined to interfere with the High Court’s judgment and dismissed the SLP.

The Ekanam project is registered with Uttar Pradesh RERA and has a proposed completion date of June 10, 2030.

The Supreme Court’s order removes the SLP challenge to the additional FAR, while the project remains subject to applicable planning permissions, building regulations and RERA requirements.

The case also brings attention to the regulatory framework surrounding additional development potential in large housing projects, particularly where existing apartment owners and future development plans overlap.
