Gujarat RERA receives notice from the High Court for dismissal of a builder case.

On 3 March Gujarat High Court issued a notice to the Gujarat Real Estate Regulatory Authority (RERA) seeking a response to the plea for dismissal on the day of the adjournment of the complaint. The RERA dismissed the argument after the declaration of an adjournment in a case, on the grounds that the party did not stay there, the petition said.

The petition was filed by Yusuf Jamal, an Uttar Pradesh resident who had booked an apartment in one of the East-West Development Ltd project in Shilaj. The issue had been moved to the Gujarat RERA.

Jamal’s Advocate, Amiraj Barot, said that Jamal filed a complaint because the developers had not constructed it. On 11 December 2019, a hearing before RERA was arranged, but on 9 December he obtained an e-mail adjourning the hearings to 17 December.

On the 17 of December, as Barot went before the proceedings, it was said that the complainant was dropped as default on December 11 because nobody showed up on behalf of the complainant. In order to prove his case was incorrectly dismissed, the prosecutor sent a copy of the e-mails obtained from the RERA official e-mail ID.

The petitioner requested the HC to revoke the dismissal order from the RERA and guide it within three months to take appropriate action against the developer.

The HC demanded a reply within two weeks by RERA and the developer, the claimant’s lawyer said.
