CREDAI seeks exemption for the projects that have received CC & OC before the RERA was enforced.

The Confederation of Real Estate Developers Associations of India (CREDAI-Pune Metro) has stated that the Registration of Real Estate Regulatory Authority (RERA) should not be required for the housing projects which have received the completion or occupancy certificate before the implementation of the RERA Act in Maharastra.

Prior to the implementation of RERA Act, the registration of RERA was not compulsory for housing projects that obtained the completion certificate or occupancy certificate.

Nonetheless, the latest circular from the Department of Revenue and Forest made it mandatory and told them that there would be no agreement for sale for any property without the registration of RERA. CREDAI Pune has claimed in a statement that this latest notification creates confusion and difficulty for home purchasers because of the reluctance of sub-registrar offices to register the documents.

CREDAI-Pune Metro requested clarification on the matter from Anil Kawde, Inspector General of Registration and Collector of Stamps Maharashtra State and Gautam Chatterjee, Chairperson, MahaRERA.

CREDAI- Pune Metro has demanded the exemption of projects that have obtained the completion certificate/ occupancy certificate before the RERA was implemented, and the exclusion from RERA registration for projects of less than 500 sq.m. and less than 8 units of land area.

It also seeks to exclude those projects with the certificate of completion and occupancy and with the agreement now signed to sell to be exempted and to release the plotting development projects where the authority has granted the final N/A certificate or final approval to the layout before RERA was enforced. In addition, CREDAI has also demanded the resale of apartments or plots in which the developer is not a party in the document to be exempted.
