The Maharashtra Government has officially announced the amnesty scheme. This scheme is mainly for the homebuyers in the state who have not completed their property registration.

Under this scheme, all the flat-owners who haven’t paid stamp duty on their purchase agreements will get an opportunity to settle-down their purchase by clearing up their stamp duty within a given time-span. And the given time-span alotted by the government is 6 months.

“While paying the stamp duty the person is supposed to pay a nominal fee” said by a senior officer.

This specific scheme is brought into place in order to allow the resident’s owners, particularly those under the Maharashtra Housing and Area Development Authority (Mhada), the City and Industrial Development Corporation (Cidco), the Slum Rehabilitation Authority (SRA), to pay their pending dues and complete the deemed conveyance transaction.

 

Procedure to Avail the stamp duty Amnesty Scheme:

Eligibility: A person who is a part of a document or is entitled to property are eligible to apply for this scheme. Also, a person holding a power of attorney is eligible.

Form A: The person is responsible to fill up the details in Form A prescribed under the scheme.

Documents: The person is liable to provide the original instrument on which inadequate stamp duty was paid, along with self-attested copies of the other supporting documents.

Deadline: He/She should apply before the end date that is 31st August 2019.

An amount payable: This is the last step in which your application will be evaluated, in which the amount of deficient duty, as well as the amount of penalty,  will be informed to you. This amount should be cleared before 60days, failing which the application will be treated as null and void.

    1) What self-attested copies of the other supporting documents required ? Please share the list ( with options like this document or that document).

    2) Is prior verification of stamp paper required ?

    3) what about registration ? paying stamp duty without registration will is enough ?

    I do not have the sale agreement for property purchased from builder in 1981. how to get the amnesty relief? so that i can clear the ownership of flat.
    Property deed is lost and not traceable.

    Hi ….my parents had purchased a flat in 1982 however stamp duty was not applicable then as per the govt. Policy, can you confirm if the flat owners who purchased flats between1979 to 1982 need to pay the stamp duty as per the amnesty scheme of 2019?

      Hi, stamp duty is compulsory in any purchase of a property, that is why amnesty scheme has come into consideration as many old properties were not charged with stamp duty. It is advisable to check with Government Office to get exact information as they might charge a penalty in future, and if possible get the confirmation in writing.

    I have purchased flat at thane in 1992.
    On that time I have paid stamp duty as per sale agreement. Some years later office has informed me that, you have to pay diff. in stamp duty, which is calculated as per ready recknor. Meantime, my original docs. retain with them. On month of December,2019 I have paid fully outstanding dues with penalty @ 400%, as per their demand. Now on Feb. 2019, office has declared stamp duty amnesty scheme @10% .
    My question is, can I eligible for refund of 90 % penalty, as per their notification ? If yes, what is the procedure…?
    Please guide me.

      The amnesty scheme is only charged on the unpaid Stamp Duty of an old flat. If the officials have sent the stamp duty charges under an amnesty scheme then there must be some outstanding left or else you need to check with them and get the update for your dues you paid on December 2019.

      As per my knowledge the place where property registration is done over there only amnesty scheme duty needs to be paid, which is Bandra (East) in your case. And that office only will guide you with paperwork. Please note: This is as per my understanding, rest government officials can only guide you in detail.

    Dear Sir this is Pandari Shetty regards to you I have purchased a flat in 1991 where I paid stamp duty and also registration done as I had taken loan from DHFL now the original is still lying g in pune office and our building is going for redevelopment how can I avail the benefit of amnesty scheme as the MC of the society and Develoers are taking all the members fir a ride from.last 2 years and asking us to pay unwanted anount of stamp duty which we have protested for the same kindly guide us thanks

    I have paid stamp duty for the flat purchased in 2001 in andheri, I have two queries relating to it.
    a) I do not know if the flat has been registered or not (as there is no round-stamp on it)
    b) Also, I have paid stamp duty, but am not sure if it is full or part.

    Where can i verify, if I have paid the correct stamp duty and also where can I verify, if my document is registered or not.

    Can i check the registration status online ?

    Wish you Good Day Abhay!!

    We were having our own plot and in year 2000 on stamp paper of Rs. 50 got into agreement with builder for development of building.
    He in turn gave us a flat whose valuation as on date as per BMC is RS. 67 lacs.

    And, based on a lawyer we visited in month of Jan 2019, he said that we have to pay duty of approx. 4 Lacs including penalty.

    Can you pls help me, if we see any benefit for me with this Amnesty?

    My father-in-law had purchased a flat in 1991 but no stamp duty was paid. Earlier, the agreement was jointly in favour of the three brothers which was later transfer to my father-in-law. Could you please guide if we need to pay the stamp duty also on all past agreements or the payment of stamp duty in the latest agreement.

    When can we expect the amesty scheme for stampduty for flats n private buildings and private housing societies(non govt.societies and buildings )as the amnesty for mhada and cidco are aleady n force.

My flat agreement value was 45 lacs, so I have paid stamp duty amount 2.25 lac & registration charge 30,000 to government. Please suggest whether my stamp duty procedure is complete or not.

    I have purchased Mhada room from my Real brother in 1999. As Mhada authorities said that time no need to pay stamp duty. We made Gift deed. Now I want to transfer Mhada room from his name to my name. What to do?

    My two party agreement for sale (on ₹ 100 stamp paper duly notorised) is of May 2004. And MHADA row house plot was transfered in my name in Jan 2006. But thereafter MHADA new rules required tripartite deed of assignment. Till date my sale document is neither registered nor duty paid. I’ve bank proofs of payment made in 2004 and IT returns reflecting property bought. How can I avail benefit of amnesty scheme ? Please guide.

      You have to apply to collector of stamps on Form A as prescribed with original agreement and payment proof.

    Hello,

    The query is regarding the Abhay Yojna 2008 amnesty scheme, Maharashtra. I had paid the required stamp duty under the schemes terms and conditions, but failed to register the document.

    I want to sale this house now but Society is not giving NOC for Mahada transfer as I haven’t register my property during last Abhay Yojna scheme.

    Can I register now my old documents ?

      Any agreement has to be registered within 4 months of its execution by both the parties. By paying penalty upto 10 times of registration fees, the agreement may be registered in 8 months. Now you may execute gift deed within family members , attach the old agreement annexure to gift deed and register. One party registration has been stopped since 2011.

      There is a liability of stamp duty on the agreement of 1995 as your father had paid stamp duty on market value. Though it was not demanded at the time of gift deed, it is advisable that, you should take the benefit of amenity scheme.

    Hi I have paid the stamp duty (including penalty) under the current amnesty scheme in August 2019 for the flat that I had purchased in 2003. Now, when I wanted to do the registration the local authorities (in Thane) are asking me to pay the stamp duty under the current rules (net of previous stamp duty paid in August 2019) and then register the property. Why do I have to pay the stamp duty again, cant I register the property with the stamp duty I paid under the amnesty scheme. Also, there is some difficulty for the seller to come for the registration as they have moved to another state and are travelling outside India most of the time, what is the solution for that as one side registration has closed since 2011. Request your help in these queries.
