CCI orders Chandigarh Housing Board to stop anti-competitive behaviour.
NEW DELHI: The Competition Commission has ordered the Chandigarh Housing Board (CHB) to stop engaging in anti-competitive acts and has decided not to levy any penalties because the organization has already implemented corrective measures.
It was claimed that CHB exploited its dominating position by, among other things, imposing unreasonable conditions and clauses on allottees in a self-financing housing plan launched in 2010.
According to an official release on Wednesday, the ‘ market for the provision of services for the development and sale of residential apartments in the Union Territory of Chandigarh’ was considered relevant for analyzing the complaint.
The Competition Commission of India (CCI) determined that CHB held a dominant position that allowed it to operate independently of the competitive dynamics in the relevant market.
Furthermore, the regulator observed non-disclosure of the date of transfer of possession to applicants of the flats, as well as the imposition of penal interest for the entire month due to a one-day delay in credit of payment.
The regulator determined that these were anti-competitive.
According to the announcement, CHB took corrective actions, and as a result, the regulator refrained from imposing any monetary penalties on the firm.
