Nearly 10 months after MahaRERA issued Rs 24 Crore recovery warrants against Nirmal Developers after they failed to repay 80 home buyers in Mulund for Nirmal Olympia project, the buyers’ money have yet to be refunded.

Homebuyers are now stuck in the blame for the recovery battle between Tehsil officials (who conduct the recovery process) and the collector of Stamps.

Homebuyers say that revenue officers seemed to have an interest in slowing developers’ recovery. MahaRERA Member Vijay Satbir Singh released three separate recovery warrants to recover arrears in February and March against Nirmal developers.

The Kurla/Mulund tehsildar has started the recovery process, after a considerable delay in the process, and has added the developer’s Jawahar Talkies to recover over Rs 23 crore from the developer. The value of the property has now been determined by revenue officers and valuation has yet to be issued by the Collector of Stamps.

When approached, Mulund-based revenue officials blamed officials from the Chembur Stamp Collector’s office for the delay in the auction process, while officials from the Stamps department blamed the tehsil revenue officials for failing to provide sufficient documents and valuation facts.

“We had written about two months ago to the officials of Tehsil, but they still have to get back to us,” said an official in the Stamp department.

Milind Borikar, a collector of the suburban district of Mumbai, said, “There has been an initial delay due to some issues in the address stated in the warrant for recovery. There was a delay later, as officials were occupied with the election process for the assembly. They will complete the process of recovery as soon as possible.”

Rahul Kshirsagar, who had booked in the project a one-BHK worth Rs 82 lakh, said, “The developer is taking the officials and buyers on a ride. We had invested about five years ago in the project and not a single brick has been laid to date.”
