A developer in Jaipur has accused a Rajasthan RERA judge of favouritism.
JAIPUR: A developer has filed a complaint with the Rajasthan RERA court against the presiding officer. He has been accused of partiality and favoritism by the developer.
As a result of this complaint, the RERA court found the developer to be non-compliant for failing to obey its orders. All directors of the builder group, as well as its chartered accountants, have received notices urging them to attend the impending hearing.
Salwinder Singh Sohata, an authority member, saw the failure to comply with the verdict on the petition as an act of disobedience.
According to a RERA officer, a petition was filed against the developer, asking for a complete refund with interest for the non-delivery of a flat in a residential project on time. Following a hearing on the petition, the authority members ordered the building group to refund the money in full by April 6, 2023.
“Despite the order, the builder group did not reimburse the complainant.” Instead, it filed a formal complaint with the authority, accusing RERA member Sohata of making a biased decision.
The builder’s CA and representatives claimed that they requested an additional hearing date in the matter, but their request was denied, resulting in an unfair judgment.”
Furthermore, two other petitions about delayed possession of flats in the same project were previously submitted to the RERA authorities.
Due to the builder’s failure to deliver on time, the petitioners sought a refund of their invested funds. However, the builder presented its case, claiming that the job was completed and requesting possession. Consequently, the RERA officials ruled in favor of the builder, rejecting the refund and ordering the delivery of the flats.
